China, Export Controls and the Policy Layer
A policy was announced. Does it bind today?
The evidence-led takeaway
An announcement is not a rule.

In brief
What this research concludes
An announcement is not a rule.
The judgment skill this hands over
When a policy headline arrives, do not start with whether it is good or bad for a stock. Ask four things in order: what kind of thing this is (a statement, a proposal, a rule, or a notice to a company); whether it binds today (in force, suspended, delayed, struck down); whose gate it is, and whether there is a second gate; and where it would show up, in the filings of the companies it actually binds and in how those filings define the number.
What we investigated
A policy was announced. Does it bind today?
This is episode 11 of Investing in the AI Era, a 14-episode course. The film tells the story; this note is the research behind it, kept inspectable.
Who and what this looks at
How we tested it
Researched to be refuted, not confirmed
Candidate claims went to an independent pass instructed to refute them against primary sources. Survivors became evidence; casualties became the refused list below.
The method, in the research team's own words
One research wave on 2026-09-05: seven primary-source policy-chronology lenses (written walled off from company outcomes) and nine outcome/adversarial lenses. Ten lenses died when the campaign hit the session limit; under the 2026-09-06 budget law a dead lane is finished and no second wave ran. Harvest used: US computing controls, AI diffusion and successors, China outbound controls, tariffs, EU AI Act, and the accelerator layer of pre-registration PR-1 (1 of 4 layers). Two TSMC facts joined from AI04. One refutation pass on 2026-09-13 over the claims the narration speaks (four refuters, one pass), including a change check for 2026-09-05 to 2026-09-13.
Pre-registered before any data was pulled
The firms, metrics and window for the quantitative work were fixed in writing before a single number was requested, so the result could not be cherry-picked after the fact. Every pre-registered case is reported regardless of direction. The full pre-registration is in the research desk.
What the evidence says
29 claims survived refutation
Each carries its source, the date the thing happened and the date it was said — two different facts — and its limits, stated by the research team rather than left for you to discover. Deterministic charts are drawn only from audited series; nothing on this page is illustrated as if it were a measurement.

What surprised us
Where the simple story did not survive
Logged by the research lanes as they worked, before anything was written. The full log is in the research desk.
- 1
No "July 2026 semiconductor tariff action" exists (closes AI01 open gap).
- 2
The AI Diffusion Rule was never formally rescinded; it is codified and unenforced.
- 3
NVIDIA held US licences for H20 and H200 and could not sell, because Beijing restricted the sales.
- 4
NVIDIA fiscal 2025 China revenue is $17.1B or $25.0B depending on the disclosure basis.
- 5
A US tariff on Chinese legacy chips was imposed at zero percent.

What remains uncertain
What we still do not know
Stated by the research team, in full, rather than smoothed over.
- Why BIS has left the AI Diffusion Rule codified but unenforced for sixteen months.
- How a revenue share with no published regulation is collected, if at all.
- How many is-informed licence notices exist that no listed company was obliged to disclose.
- Whether either November 2026 suspension will be renewed, lapse, or be replaced.
- PR-1 tool, EDA and memory layers: not run.
- Taiwan concentration by any measured basis: not sourced in this harvest.
- Whether H200 shipments into China have since been approved on the Chinese side (unverified press report).
- Whether BIS publishes the formal diffusion-rule rescission before the fiscal year ends on 2026-09-30.
What we refused to publish
13 claims we would not say — and why
The do-not-narrate list. Some are popular; some are true but unproven; some are simply not this note’s to make. Each refusal is enforced in production, not just recorded.
- UnverifiableX01
“China's domestic AI-chip output: Huawei Ascend unit counts, SMIC yields, CXMT HBM stacks, domestic share of China's high-end AI market.”
Verdict: UNVERIFIABLE - inherited from the pilot
Why: Credible estimates for the same variable differ by more than 2x and none are company-disclosed. Carried forward by the AI11 contract.
- UnverifiableX02
“The instruments that suspended the measures state that they were part of a deal, or one suspension was given in exchange for the other.”
Verdict: UNVERIFIABLE - the BIS stay rule states no reason; the pairing is stated in the White House fact sheet as commitments within a deal, and a one-for-one exchange is not established
Why: The film narrates the fact sheet as a statement and the stay rule as the instrument (F28, F29). It says nothing about MOFCOM Announcement No. 70's stated reasons, which were not checked.
- UnverifiableX03
“Any export control or tariff caused a named stock to move.”
Verdict: UNVERIFIABLE
Why: No price-attribution analysis was run; AI10 owns co-movement.
- RefutedX04
“The AI Diffusion Rule was formally rescinded or repealed in May 2025.”
Verdict: REFUTED
Why: Rescission was announced and enforcement suspended; no Federal Register rescission has been published as of September 2026.
- RefutedX05
“China banned rare earth exports.”
Verdict: REFUTED
Why: Announcement No. 18 of 2025 is a global licensing requirement, not a ban. Announcement No. 46 of 2024 para. 1 (military end users) is a prohibition and is separate.
- RefutedX06
“A "July 2026 semiconductor tariff action".”
Verdict: REFUTED
Why: No such action exists. Closed AI01 gap: see course/research/AI11-lanes/AI01-DEBT-RESOLVED.md.

- RefutedX07
“A 100 percent semiconductor tariff was imposed.”
Verdict: REFUTED
Why: Stated 2025-08-06; never implemented by any instrument.
- RefutedX08
“Measures that take effect immediately survive; long runways are where policy dies.”
Verdict: REFUTED by the register
Why: Gallium/germanium, graphite and antimony bound after 29-42 day runways; the Affiliates Rule and Announcement 62 took effect on publication and were suspended.
- UnverifiableX09
“A percentage of the world's advanced chips made in Taiwan.”
Verdict: UNVERIFIABLE - the Taiwan lens died before any measured basis was sourced
Why: Widely repeated figures carry undefined bases (wafer starts, capacity, revenue). Not narrated.
- UnverifiableX10
“The H20 licence notice was secret, unlawful or a hidden rule.”
Verdict: UNVERIFIABLE - nothing in the record supports it
Why: An is-informed notice is an established BIS mechanism; the film says only that it was not published as a rule.
- RefutedX11
“Geographic revenue shows where chips were used.”
Verdict: REFUTED by the issuers
Why: NVIDIA, Broadcom and Marvell each say their geographic line is not end use; NVIDIA estimates 76% of Data Center revenue from Taiwan-headquartered customers was attributed to US and European end customers.
- UnresolvableX12
“PR-1 findings for the tool, EDA and memory layers.”
Verdict: UNRESOLVABLE - not run; those lenses died at the session limit
Why: Those lenses died at the session limit; no second wave under the budget law. Nothing about those layers is claimed.
- Partly unverifiableX13
“GTG-1002 as an established AI-orchestrated state cyberattack.”
Verdict: PARTIALLY UNVERIFIABLE - inherited from AI09, where it was marked misleading
Why: No published indicators of compromise; the vendor's own summary says the model overstated findings.
